Welcome to Topiary 4U.

These Terms & Conditions (“Terms”) govern your access to and use of the Topiary 4U website and your purchase or use of our products, custom designs, sculptures, services, and related offerings.

By accessing our website, submitting a custom quote request, placing an order, or purchasing a product from Topiary 4U, you agree to these Terms.

If you do not agree to these Terms, please do not use the website or place an order.

1. About Topiary 4U

Topiary 4U creates and sells handcrafted topiary frames, moss topiaries, garden sculptures, custom wire-frame structures, decorative displays, and related products for residential, commercial, garden, retail, hospitality, event, and other uses.

We also offer custom-designed topiary sculptures based on customer specifications, concepts, dimensions, and reference materials.

2. Website Use

You may use this website only for lawful purposes.

You agree not to:

  • Use the website for fraudulent or unlawful purposes
  • Attempt to interfere with the security or operation of the website
  • Introduce malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Copy or exploit website content for unauthorized commercial purposes
  • Provide false or misleading order or contact information
  • Use the website in a manner that infringes another person’s intellectual-property or other legal rights

We reserve the right to restrict or terminate access to the website where misuse is suspected.

3. Product Information

We make reasonable efforts to display our products, descriptions, dimensions, materials, prices, photographs, and other information accurately.

Because our products are handcrafted, individual products may differ slightly from photographs or samples shown online.

Minor variations in dimensions, shaping, wire placement, moss texture, coloration, construction, finish, natural materials, or other handcrafted characteristics are normal and do not necessarily constitute defects.

Colors may also appear differently depending on lighting, photography, computer monitors, mobile devices, and other display settings.

4. Handcrafted and Natural Products

Many Topiary 4U products are individually handcrafted and may incorporate wire, metal frames, preserved moss, natural plant materials, or other materials that naturally vary.

Customers acknowledge that handcrafted items are not mass-produced and that reasonable variations contribute to the individual nature of each piece.

Images on the website should therefore be considered representative of the general design and appearance rather than a guarantee that every item will be identical.

5. Orders and Acceptance

Submitting an order does not necessarily mean that the order has been accepted.

We reserve the right to refuse, cancel, limit, or modify an order for legitimate reasons, including:

  • Product unavailability
  • Incorrect pricing or product information
  • Suspected fraud
  • Shipping limitations
  • Production limitations
  • Errors in an order
  • Inability to fulfill a requested custom design

If we cancel an order after payment has been received, we will refund the applicable amount unless payment relates to nonrefundable custom work that has already begun in accordance with these Terms.

6. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

We may change prices at any time. Price changes do not affect orders already accepted unless an obvious pricing error occurred.

Custom-design pricing depends on factors that may include:

  • Size
  • Design complexity
  • Materials
  • Quantity
  • Intended use
  • Structural requirements
  • Shipping requirements
  • Production timeline
  • Installation or project requirements

A custom quote is valid only for the period, scope, and specifications stated in that quote.

Changes requested after approval may result in additional charges.

7. Payment

Payment is due according to the terms shown at checkout, on an invoice, or in a custom-project quote.

Depending on the project, Topiary 4U may require full payment or a deposit before beginning work.

You represent that you are authorized to use the payment method provided.

We may use third-party payment processors to process transactions. Their separate terms and privacy policies may apply to payment processing.

8. Taxes

Applicable sales tax or other legally required taxes may be added to your order based on the nature of the transaction, delivery location, and applicable law.

Customers are responsible for any taxes, duties, customs charges, import fees, or similar charges not collected by Topiary 4U where applicable.

9. Custom Designs and Commissioned Work

Custom topiary sculptures and commissioned designs are created specifically for the customer and may require substantial planning, labor, materials, and production time.

A custom project may begin after the customer approves the applicable design direction, specifications, quote, deposit, or other project requirements.

Custom Orders Are Final Once Production Begins

Once production or fabrication of a custom, personalized, commissioned, or special-order product has begun:

  • The order is noncancelable unless Topiary 4U agrees otherwise in writing.
  • Custom work is nonreturnable.
  • Payments and deposits relating to work already commenced are nonrefundable.

If a customer requests significant changes after production begins, additional design, material, labor, or production charges may apply.

Topiary 4U will communicate material changes to the project scope before proceeding where reasonably possible.

10. Custom Production Times

Production times for custom products vary depending on the complexity, dimensions, materials, quantity, production schedule, and project requirements.

Typical custom orders may require approximately 4–8 weeks, but this is an estimate rather than a guaranteed completion date unless a specific deadline has been expressly agreed to in writing.

Large, complex, commercial, or high-quantity projects may require additional production time.

Customers with event dates or installation deadlines should disclose those dates before placing an order.

11. Customer-Supplied Designs and Reference Materials

You may provide photographs, drawings, logos, artwork, measurements, concepts, or other materials to help us understand a custom-design request.

By providing these materials, you represent that you own them or otherwise have permission to use and provide them to Topiary 4U for the requested project.

You grant Topiary 4U permission to use those materials as reasonably necessary to evaluate, design, quote, manufacture, and complete your project.

You are responsible for claims arising from materials you provide that infringe another person’s copyright, trademark, privacy, publicity, or other rights.

12. Design Interpretation

Custom topiary work involves artistic and handcrafted interpretation.

While we make reasonable efforts to follow agreed specifications, a handmade sculpture may not be a mathematically or photographically exact reproduction of an animal, object, person, logo, drawing, photograph, or other reference.

Reasonable artistic, structural, and manufacturing adjustments may be required to create a stable and practical finished piece.

13. Shipping and Delivery

Shipping costs depend on factors such as product size, weight, destination, packaging requirements, and shipping method.

Some large items may ship in multiple sections or packages to make transportation and assembly safer and more practical.

Any delivery estimate provided by Topiary 4U or a shipping carrier is an estimate unless expressly guaranteed in writing.

We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, severe weather, transportation disruptions, natural disasters, labor disruptions, customs delays, or incorrect delivery information supplied by the customer.

Customers are responsible for providing a complete and accurate delivery address.

14. Inspection of Deliveries

Please inspect your order promptly after delivery.

If an item arrives damaged, incomplete, or materially different from what was ordered, contact us as soon as reasonably possible at info@topiary4u.com and provide:

  • Your order information
  • A description of the issue
  • Photographs of the product
  • Photographs of the packaging where shipping damage is involved

Customers should retain packaging while a shipping-damage claim is being reviewed.

We may request additional information necessary to evaluate the issue and determine an appropriate resolution.

15. Returns and Refunds

Custom, commissioned, personalized, and special-order products are subject to the custom-order provisions above and are generally nonreturnable and nonrefundable once production has begun.

For non-custom products, return eligibility may depend on the product’s condition, reason for return, and any return or shipping policy provided at the time of purchase.

Customers must contact Topiary 4U before returning an item. Products should not be shipped back without prior authorization.

Unless an item is defective, damaged during shipment, or incorrect due to an error by Topiary 4U, customers may be responsible for return-shipping costs and original shipping charges may be nonrefundable where permitted by law.

Nothing in these Terms limits any non-waivable rights available to consumers under applicable law.

16. Assembly, Installation, Planting, and Care

Some topiary frames are designed and shipped in sections and may require customer assembly.

Customers are responsible for following any provided assembly, installation, planting, watering, lighting, maintenance, and care instructions.

Conditions affecting live plants and outdoor installations vary considerably based on climate, watering, soil, sunlight, plant species, weather, location, pests, and maintenance.

Topiary 4U cannot guarantee the survival or growth performance of plants supplied or installed by the customer.

Customers are responsible for determining whether a product is appropriate for their location and intended use.

17. Commercial and Event Projects

Large commercial, hospitality, retail, public-space, event, and installation projects may be subject to separate quotes, project specifications, payment schedules, production terms, shipping arrangements, or written agreements.

Where a separately signed agreement conflicts with these Terms, the signed agreement will control with respect to that project.

18. Intellectual Property

Unless otherwise stated, the website and its content are owned by or licensed to Topiary 4U and are protected by applicable intellectual-property laws.

Protected content may include:

  • Text
  • Product descriptions
  • Photographs
  • Graphics
  • Logos
  • Website design
  • Product imagery
  • Original designs
  • Custom artwork
  • Videos
  • Branding and other website content

You may not reproduce, distribute, modify, republish, sell, or commercially exploit our website content without prior written permission.

19. Third-Party Links and Services

Our website may link to third-party websites or use services operated by third parties, including payment processors, shipping providers, maps, analytics tools, or other technology providers.

We do not control these third parties and are not responsible for their websites, availability, security, policies, content, or practices.

Use of third-party services may be governed by separate terms.

20. Website Availability

We do not guarantee that the website will always be available, error-free, secure, or uninterrupted.

We may modify, suspend, discontinue, update, or restrict parts of the website at any time.

21. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.

Except for warranties expressly provided by Topiary 4U or warranties that cannot legally be excluded, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be waived.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Topiary 4U will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the website, products, custom projects, shipping delays, installation, planting, maintenance, or inability to use a product.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

These limitations do not apply where prohibited by law.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold Topiary 4U harmless from third-party claims, damages, liabilities, losses, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or materials you provide for a custom project.

24. Force Majeure

Topiary 4U will not be responsible for delay or failure caused by events reasonably outside our control, including natural disasters, fires, floods, severe weather, labor disputes, transportation interruptions, supply shortages, utility failures, government actions, public emergencies, carrier delays, or similar circumstances.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to these Terms, the website, or transactions with Topiary 4U will be subject to the jurisdiction of the appropriate state or federal courts serving the area in which Topiary 4U operates in California.

26. Changes to These Terms

We may update these Terms periodically.

Changes become effective when the revised Terms are posted on the website unless otherwise stated.

The “Last Updated” date at the top of this page identifies the most recent revision.

Your continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.

27. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy, applicable checkout information, custom quotes, invoices, and any separately signed agreements, constitute the applicable agreement between you and Topiary 4U regarding your use of the website and purchases from us.
